eyada.com's Web page stated: "Our goal is simple: create original, compelling, highly-targeted programming delivered via the Internet." But exactly whom were they "targeting," and in what way? eyada.com's "Dan and Scott Show" targeted me with the use of clips of my voice and the false use of my name, which were used to target random victims with abuse and threats of prosecution. eyada.com broadcasted these telephone conversations for commercial gain in the form of advertising revenues.
Clips of my voice were obtained from two telephone calls which "The Dan and Scott Show" made to me in June of 1996. I regarded the first call as harassment due to the circumstances under which it occurred; when they called a second time immediately after I hung up, I threatened to call the police. These clips were used in October 2000 to call a phone sex operator and threaten her with prosecution, using both my name and my voice. In addition, some clips of a 1998 phone call which I had made to "The Dan and Scott Show" in early 1998, when I completely lost my temper at them for a libel against my mother by a member of their "Phreak Army," were used. I have not had any more recent contact with them than that, other than their leaving several messages on my answering machine since then.
Following a correspondence with my attorney, eyada.com's lawyers have stated that eyada.com has removed all references to me from its Web site and has instructed Dan and Scott not to make any further reference to me. I have not received any apology, or any indication that their overall policy in making broadcasts of this type has changed. Nor did eyada.com inform me of the many other threatening phone calls which they made using my name and recorded voice. Moreover, it appears that eyada.com has merely switched to sneakier tactics, such as using "Blank McBlank" on their Web page; they did not respond to any inquiries about the significance of that reference, but E-mail which I received states that they used my actual name in an April 2001 audio broadcast.
The use of my voice to deliver the threat was euphemistically referred to on eyada.com's Web site as "phone sex," and the same site indicates that "phone sex," with a variety of names being mentioned, is a frequent feature of the "Dan and Scott Show."
I can make the audio recordings of the fraudulent calls available to people who I believe have a legitimate interest in the matter.
A text transcription follows of the telephone call which the "Dan and Scott Show" made in the early morning hours of October 18, 2000, and made available in their archives. Because of buffering lags in the streaming audio, there are gaps which are noted in the transcription. I've copied this to the best of my ability, but there might be minor errors not affecting the substance of what was said. To protect the privacy of people other than myself whose voices were used without their consent, I have indicated names by initial only.
